In India, skill-based games, such as online fantasy sports, are generally recognized as lawful, with some exceptions contingent on regional regulations. The Public Gambling Act, 1867 (“PGA, 1867”) oversees gambling activities in India, categorizing “public gambling” and the operation of gaming houses as criminal offenses.

However, the PGA does not encompass games predominantly governed by skill. Online fantasy sports fit this description, as they require participants to apply their knowledge, judgment, and strategic planning to build and manage their teams. This skill-based exemption means that fantasy sports are not subjected to the same legal constraints as games of chance.

REGULATORY EXCEPTIONS IN SIKKIM, ASSAM, ODISHA, TELANGANA, ANDHRA PRADESH, AND NAGALAND

While online fantasy sports are broadly accepted in India, certain states have implemented their own regulations that may impact the operation of fantasy sports platforms. In states such as Sikkim, Assam, Odisha, Telangana, Andhra Pradesh, and Nagaland, the legal status of skill-based games and online fantasy sports can be restrictive or ambiguous.

To ensure compliance with these regional laws, Tencricplay restricts residents of these states from engaging in paid fantasy sports contests. This precautionary measure helps us adhere to local regulations and avoid potential legal challenges. Users from these states may still participate in free-to-play games and contests but are excluded from those involving monetary stakes.
